When a user registered on Squares.moda or Squares.moda Style Notes uses a company or business name, logo, or other trademark-protected materials on Squares.moda or Squares.moda Style Notes in a manner that may mislead or confuse others with regard to its brand or business affiliation may be considered a trademark policy violation.

How Does Squares.moda and Style Notes Respond To Reported Trademark Policy Violations

When we receive reports of users violating trademark policy from holders of federal or international trademark registrations, we review the account and may take the following actions:

When there is a clear intent to mislead others through the unauthorized use of a trademark, Squares.moda may suspend the account and notify the account holder.

When we determine that an account appears to be confusing users, but is not purposefully passing itself off as the trademarked good or service, we give the account holder an opportunity to clear up any potential confusion. We may also release a username for the trademark holders active use. 

What Is not a Trademark Policy Violation on Squares.moda and Style Notes

Using anothers trademark in a way that has nothing to do with the product or service for which the trademark was granted is not a violation of the Squares.moda trademark policy.

Squares.moda Style Notes usernames are provided on a first-come, first-served basis and may not be reserved. 

Guidelines for Style Notes, Commentary, and Sharing

Squares.moda Style Notes provides a platform for users to share and receive a wide range of ideas and content, and we greatly value and respect our users expression. Because of these principles, we do not actively monitor users content and will not edit or remove user content, except in cases of violations of our Terms of Service.

An accounts profile information should make it clear that the account is not actually the company or business entity that is the subject of the style notes commentary. Here are some suggestions for distinguishing your account:

USERNAME : The username should not be the trademarked name of the subject of the style notes.

NAME : The profile name should not be the trademarked name of the subject of the style notes or include the trademarked name in a misleading manner.

Communication with other users : The account should not, through private or public communication with other users, try to deceive or mislead others about your identity.

Users may also choose to use different language to indicate that an account is not associated with the actual brand, company or product so long as it is clear and not confusing to others, and does not mislead or deceive. 

In the case where an account is reported to be confusing we may request that the account holder make further changes to bring the account in compliance with these best practices. 

What Information is Required When Reporting Trademark Policy Violations

In order to investigate trademark policy violations, please provide all of the following information: 

Username of the reported account (www.Squares.moda/StyleNotes/example),Your company name, Your company Squares.moda account (if you have one), Company website, Your trademarked word, symbol, etc., Trademark registration number, Trademark registration office.

Please provide your mailing address, telephone number, and email us with your company email address.

Include both of the following statements in the body of the Notice:

"I hereby state that I have a good faith belief that the disputed use of the copyrighted material or reference or link to such material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."

"I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

Provide your full legal name and your electronic or physical signature.

Deliver this Notice, with all items completed.

Note: A federal or international trademark registration number is required. If the name you are reporting is not a registered mark (e.g., a government agency or non-profit organization), please let us know: 

Your first and last name, title, phone, address, email must be from company domain, Description of confusion, example: passing off as your company, including specific descriptions of content or behavior, Requested Action example: removal of violating account or transfer of trademarked username to an existing company account.

How Do I Report a Trademark Policy Violation

Please submit trademark-related requests from your company email address and follow the format defined above to help expedite our response. Also be sure to clearly describe to us why the account may cause confusion with your mark or how the account may dilute or tarnish your mark.

Holders of registered trademarks can report possible trademark policy violations to Squares.moda's Policy Team by submitting to the Copyright and Trademark Officer CopyrightTrademarksOfficer@Squares.moda detailed in our Terms of Use and Service

What if I receive a Copyright Complaint (DMCA) notification

If you receive a notification that an image or text has been removed due to a copyright complaint, it means that the content has been deleted from Squares.moda or Squares.moda Style Notes at the request of the content's owner. If your account receives too many copyright complaints, you may lose the ability to add new content on Squares.moda or Squares.moda Style Notes, and your account may be disabled completely.

If you believe content was removed in error, you have the option to file a counter-notice by following the steps below. When we receive a valid counter-notice, we will forward a copy to the person who filed the original complaint. If we do not receive notice within 10 business days that the submitter of the original complaint is seeking a court order to prevent further infringement of the content at issue, we will remove the complaint from your account's record, and we may replace the content that was removed. 

Note: There are legal and financial consequences for fraudulent and/or bad faith submissions. Before submitting a counter-notice, be sure that you are the actual rights holder of the removed content or that you have a good faith belief that the material was removed in error, and understand the repercussions of submitting a false claim. 

How to File a Counter-Notice

1. Email your counter-notice to CopyrightTrademarksOfficer@squares.moda

2. Include ALL of the following:

2.1 Your name, address, and telephone number.

2.2 DMCA ID printed at the bottom of the notification email.

2.3 The source address of the content that was removed 

2.4 A statement under penalty of perjury that you have a good faith belief that the content was removed in error.

2.5 A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United Kingdom, for any judicial district in which Squares.moda may be found, and that you will accept service of process from the person who provided the original complaint or an agent of such person.

2.6 A physical or electronic signature (for example, typing your full name).

Squares.moda respects the trademark rights of others. Accounts with usernames, Style Notes text, or any other content that misleads others or violates another's trademark may be updated, transferred or permanently suspended.

Squares.moda will review your submission and take whatever action, in its sole discretion, it deems appropriate, including temporary or permanent removal of the trademark from the Squares.moda site.
